The lawsuit, filed by the APC North Central Group, was rejected on multiple grounds by Justice Inyang Ekwo.
Justice Ekwo ruled that the group lacks legal standing, as it is not a registered entity and, therefore, cannot bring a case to court.
The judge also noted that the group failed to follow the APC’s internal processes for resolving disputes before approaching the court.
He also pointed out that the appointment of party officers by the APC’s National Executive Committee is an internal matter, beyond the court’s jurisdiction.
The APC North Central Group had filed the suit against Ganduje, the APC, and the Independent National Electoral Commission (INEC), claiming Ganduje’s appointment violated the party’s constitution.
They specifically argued that the selection process breached Article 13 of the APC Constitution, as it wasn’t conducted democratically.
The group, led by Saleh Zazzaga, also contested Ganduje’s appointment, stating that the position should have gone to someone from the North Central zone.
They requested that Ganduje be barred from continuing as chairman and asked the court to stop INEC from recognizing any actions taken by the APC since his appointment on August 3, 2023.
