The Supreme Court on Thursday dismissed an appeal by Tonye Cole, the candidate of the All Progressives Congress in the Rivers State governorship election.
Cole urged the highest court to remove Siminalayi Fubara from the governorship position, alleging that the election was tainted by irregularities.
He claimed that Fubara failed to properly resign from his previous position, as mandated by law, before the election took place.
His case was dismissed by both the tribunal and the Court of Appeal for lack of merit. Justice Ibrahim Saulawa, reading the lead judgment, also dismissed Cole’s appeal.
The five-man panel, in a unanimous decision, declared that the appellant did not provide evidence to support his allegations of non-compliance with the Electoral Act during the election
