American rapper, Megan Thee Stallion has refuted allegations made against her by her former cameraman, Emilio Garcia, in a recent lawsuit.
In the lawsuit filed in Los Angeles Superior Court, Garcia claimed that he was present in a moving vehicle with Megan Thee Stallion while she had sex with another woman during a trip to the Spanish holiday island of Ibiza.
Garcia accused the rapper, whose real name is Megan Pete, of harassment and creating a hostile work environment.
The lawsuit, filed on Tuesday, detailed the alleged incident which occured in June 2022 while Garcia was on tour with Megan Thee Stallion.
It claimed that Megan Thee Stallion instructed Garcia not to discuss the incident and would allegedly make derogatory comments about his weight and eating habits.
“On or around June 2022, plaintiff was traveling on tour with Stallion in Ibiza, Spain. After a night out, plaintiff, Stallion, and three other women were riding in a SUV together. Suddenly, Stallion and one of the other women start having sex right beside plaintiff,” the filing claims.
“Plaintiff could not get out of the car as it was both moving and he was in the middle of nowhere in a foreign country. Plaintiff was embarrassed, mortified and offended throughout the whole ordeal,” it continues.
“The following day, Stallion inquired whether the plaintiff was in the SUV the previous night. Plaintiff confirmed that he was in the SUV. Subsequently, Stallion instructed, ‘Don’t ever discuss what you saw.’”
The suit adds, “Stallion berated and directed her fat-shaming comments towards plaintiff such as ‘Fat bitch,’ ‘Spit your food out,’ and ‘You don’t need to be eating.'”
Garcia claimed that he felt embarrassed, mortified, and offended throughout the ordeal, unable to leave the moving vehicle in a foreign country.
“Plaintiff could not get out of the car as it was both moving and he was in the middle of nowhere in a foreign country,. Plaintiff was embarrassed, mortified and offended throughout the whole ordeal,” the suit says.
According to Garcia’s lawyer, Ron Zambrano, the incident and subsequent exposure to such behavior were deeply inappropriate and violated legal boundaries.
“Emilio should never have been put in a position of having to be in the vehicle with her while she had sex with another woman.
“‘Inappropriate’ is putting it lightly. Exposing this behavior to employees is definitely illegal,” said Garcia’s lawyer Ron Zambrano.
Garcia’s lawsuit also highlights his employment status as an independent contractor, which deprived him of benefits such as health care and overtime pay, despite working long hours and being subjected to demands outside of his designated work schedule.
The lawsuit, citing retaliation and violations of state Labor Code, lists Megan Thee Stallion, Megan Thee Stallion Entertainment, Inc., Hot Girl Touring LLC, and Roc Nation as defendants. Garcia seeks unspecified compensatory and punitive damages.
“Megan just needs to pay our client what he’s due, own up to her behavior and quit this sort of sexual harassment and fat-shaming conduct,” Garcia’s attorney said,
In response, Megan Thee Stallion’s lawyer, Alex Spiro, dismissed the allegations as a mere employment dispute aimed at monetary gain, with no claims of sexual harassment.
Spiro said, “This is an employment claim for money — with no sexual harassment claim filed and with salacious accusations to attempt to embarrass her,” the lawyer told the outlet. We will deal with this in court.”
