The Supreme Court has overturned the rulings of both the Court of Appeal and the Federal High Court, which had removed Senator Samuel Anyanwu from his position as the National Secretary of the People’s Democratic Party (PDP).
A five-member panel of the court ruled that the selection of the PDP’s National Secretary falls under the party’s internal affairs, making it a matter that cannot be decided by the courts.
Delivering the lead judgment, Justice Jamilu Tukur struck down the October 2024 ruling of the trial court and also nullified the Court of Appeal’s majority decision from December, which had upheld Anyanwu’s removal.
The Supreme Court sided with the minority judgment from Justice Ekanem, who had dismissed the case due to lack of jurisdiction.
The court ruled that Aniagu Emmanuel, the plaintiff who initially filed the case, lacked the legal standing to do so, as he failed to prove how the appointment of the PDP National Secretary personally affected him.
